Cheshire East desperately needs to avoid a S114 notice bankruptcy because if government officials run the council residents’ interests come second to balancing books, councillors said.
Several councillors at a finance sub-committee meeting yesterday (November 7) feared the prospect of a S114 notice could become a reality.

At the last Council meeting, the Labour Leader of Cheshire East Council resigned just before he was due to face a vote of no confidence.
Sam Corcoran stated that he had to take responsibility after a report highlighted bankruptcy fears.

Cheshire East could be facing effective bankruptcy unless it acts soon after its low reserves, historic overspending, challenging savings targets and inadequate Ofsted rating were highlighted in an external review.
The corporate peer challenge, conducted by senior councillors and officers from other authorities, was critical of many aspects of Cheshire East’s operation.

Cheshire East Council is not at risk of going “bankrupt”, said its finance sub-committee chair.
And if it did ever have to trigger a S114 notice suppliers and staff would be paid, claims Cllr Nick Mannion.
Cheshire East Council has hit back at speculation it is about to go bust, saying it is “working extremely hard” to address financial pressures without triggering a Section 114 notice.
Speculation has been rife since the press suggested the cash-strapped council may be forced to declare bankruptcy following the government’s decision to scrap the northern leg of HS2.
